Gaming, GameFi and NFTs: three different regulatory problems

These get bundled together in conversation and pulled apart by regulators. Which authority you answer to depends on whether money is staked on an uncertain outcome, whether a token is tradeable for value, and who controls the platform.

Commercial gaming sits with the GCGRA

The General Commercial Gaming Regulatory Authority is the UAE federal body regulating commercial gaming. It licenses entities and individuals separately — operators, vendors and corporate key persons on one side, key persons and gaming employees on the other. Most businesses need several licences at once.

Vendors are licensed in their own right. A studio, platform provider or supplier selling into a licensed UAE operator needs its own approval. Assuming your operator client's licence covers you is the most common and most expensive mistake in this sector.

GameFi and play-to-earn are usually a virtual-asset question

Once in-game value is tradeable outside the game, you are likely carrying on a virtual-asset activity — which means VARA in Dubai outside the DIFC, or ADGM's FSRA. The questions that decide it:

• Can the in-game asset be sold, swapped or cashed out for value outside your environment?
• Do you operate the marketplace where that happens, or merely permit it?
• Do you hold player assets or keys — and if so, is that custody?
• Is there any element of stake, chance and prize? That points at gaming regulation regardless of the wrapper.
• Does the token carry a yield, a revenue share or a redemption promise? That points somewhere else again.

NFTs are classified by function, not by format

A pure collectible, a fractionalised real-world asset, an access pass and a revenue-sharing token are four different regulatory objects that happen to share a file standard. We classify each by what it actually does for the holder before recommending a route.
